Refund and Cancellation Policy

Ryan Driving School (“we”, “us”, “our” or “Ryan Driving School”) provides driving lessons and related services in Victoria, Australia.
We understand that plans can change. This Refund and Cancellation Policy explains the requirements for cancelling or changing a driving lesson booking.
This policy is intended to operate in accordance with the Australian Consumer Law (ACL) and applicable Victorian laws. Nothing in this policy excludes, restricts or modifies any consumer guarantee or other right that cannot legally be excluded.
1. Cancellation more than 24 hours before a lesson
If you cancel your driving lesson at least 24 hours before the scheduled lesson start time, you will generally be eligible for a full refund of the amount paid for that lesson.
The cancellation must be received by Ryan Driving School at least 24 hours before the scheduled start time.
2. Cancellation within 24 hours of a lesson
If you cancel your lesson less than 24 hours before the scheduled start time, the booking will generally be non-refundable.
This includes cancellations made on the day of the lesson or cancellations made less than 24 hours before the scheduled appointment.
This condition applies because late cancellations may prevent Ryan Driving School from offering the appointment to another learner and may result in the instructor being unable to use the allocated time.
Where appropriate, Ryan Driving School may offer to reschedule the lesson instead of providing a refund.
3. Failure to attend a lesson
If a learner does not attend their scheduled lesson and does not provide at least 24 hours' notice, the lesson will generally be non-refundable.
If the learner arrives late, the lesson may still finish at the originally scheduled time and the full lesson fee may apply.
4. Rescheduling a lesson
Learners may request to reschedule a lesson by providing at least 24 hours' notice.
Subject to instructor availability, the lesson may be moved to another suitable time without an additional cancellation fee.
Requests made less than 24 hours before the scheduled lesson may be subject to the same conditions as a late cancellation.
5. Cancellation by Ryan Driving School
If Ryan Driving School needs to cancel a lesson, we will generally offer the learner:
a replacement lesson at a mutually suitable time; or
a refund where appropriate.
We will communicate the cancellation as soon as reasonably practicable.
6. Exceptional circumstances
Ryan Driving School may consider exceptional circumstances involving a late cancellation on a case-by-case basis.
Examples may include:
serious illness or injury;
an emergency;
unsafe driving conditions;
significant circumstances outside the learner's reasonable control; or
circumstances that make it unreasonable or unsafe for the lesson to proceed.
Supporting information may be requested where reasonably necessary.
7. Consumer rights under Australian Consumer Law
Our 24-hour cancellation policy applies to ordinary cancellations and changes of mind. It does not remove or limit rights provided under the Australian Consumer Law.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with the service, you are entitled:
to cancel your service contract with us; and
to a refund for the unused portion, or compensation for its reduced value.
You are also entitled to compensation for any other reasonably foreseeable loss or damage resulting from a failure to comply with a consumer guarantee.
For a minor problem, Ryan Driving School will generally have an opportunity to remedy the problem within a reasonable time. If the problem cannot be appropriately remedied, further remedies may apply under the Australian Consumer Law.
These rights apply regardless of the 24-hour cancellation period.
8. Change of mind
Where a learner simply changes their mind about a booking, the Ryan Driving School 24-hour cancellation policy will apply.
Accordingly:
24 hours or more before the lesson: eligible for a refund.
Less than 24 hours before the lesson: normally no refund, subject to any applicable consumer rights or exceptional circumstances.
Australian Consumer Law rights relating to defective or improperly provided services are not affected by this change-of-mind policy.

1. Driving Lessons
Ryan Driving School provides driving instruction and related services in Victoria.
Driving lessons are subject to instructor availability and may be provided in an automatic or manual vehicle, depending on the instructor and booking selected.
Our instructors will provide driving instruction with appropriate care and skill and in accordance with applicable road safety and regulatory requirements.
Professional driving instructors in Victoria must hold the required driving instructor authority when teaching an unlicensed person to drive a car.
2. Bookings
Bookings may be made through our website, by phone, email or other booking methods offered by Ryan Driving School.
A booking is confirmed when Ryan Driving School confirms the appointment and, where applicable, payment has been received.
Customers are responsible for providing accurate booking information, including their name, contact details and preferred lesson time.
3. Lesson Times
Customers should arrive at the agreed meeting location at least a few minutes before the scheduled lesson.
If a customer arrives late, the lesson will generally finish at the originally scheduled time unless the instructor agrees otherwise.
A late arrival may therefore result in a shorter lesson while the normal lesson fee remains payable.
4. Cancellation and Refunds
Our cancellation and refund policy applies to driving lesson bookings.
Cancellation 24 hours or more before the lesson
If you cancel at least 24 hours before the scheduled lesson, you will generally be eligible for a full refund or, where agreed, a rescheduled lesson.
Cancellation less than 24 hours before the lesson
If you cancel less than 24 hours before the scheduled lesson, the booking will generally be non-refundable.
This includes cancellations made on the day of the lesson.
Ryan Driving School may consider exceptional circumstances on a case-by-case basis.
Nothing in this section limits any rights you may have under the Australian Consumer Law.
5. No-Show
If you do not attend your scheduled lesson and have not provided at least 24 hours' notice, the lesson will generally be treated as a late cancellation and the lesson fee may be retained.
This does not affect any rights or remedies available to you under applicable consumer law.
6. Rescheduling
Customers may request to change their lesson time by providing at least 24 hours' notice.
Rescheduling is subject to instructor availability.
Requests made less than 24 hours before the lesson may be treated as a late cancellation.
7. Instructor Cancellation
If Ryan Driving School or an instructor needs to cancel a lesson, we will generally offer:
an alternative lesson time; or
a refund for the cancelled lesson, where appropriate.
We will provide reasonable notice where circumstances allow.
Where a service has been paid for but cannot be supplied, applicable consumer rights will apply.
8. Learner Requirements
Learners must provide accurate information about their licence or learner permit status when required.
Learners must comply with reasonable instructions given by the instructor during lessons.
A learner must not drive a vehicle during a lesson if they are not legally permitted or authorised to do so.
Where applicable, the learner must meet Victorian licensing and road-law requirements.
9. Safety
Safety is a priority during all driving lessons.
An instructor may stop or refuse to continue a lesson if they reasonably believe that continuing would create an unsafe situation.
This may include circumstances involving:
unsafe vehicle conditions;
dangerous weather or road conditions;
learner behaviour that creates a safety risk;
impairment by alcohol or drugs; or
any other circumstance that creates an unacceptable safety risk.
Where a lesson cannot safely proceed, Ryan Driving School will consider the circumstances and any applicable consumer rights.
10. Pricing and Payment
The applicable lesson price will be communicated to the customer before or at the time of booking.
Customers are responsible for paying the agreed price for the services booked.
We will provide appropriate payment or booking confirmation records.
Any additional charges will be disclosed before they are incurred where reasonably practicable.
11. Australian Consumer Law
Ryan Driving School acknowledges that Australian Consumer Law provides consumers with statutory guarantees when purchasing services.
Our services must be provided with appropriate care and skill, be reasonably fit for any purpose communicated to us, and be supplied within a reasonable time where no timeframe has been agreed.
If a service does not meet a consumer guarantee, the consumer may have rights to a remedy depending on the circumstances.
